Fabio Cesare, partner of MCM Avvocati since 2005, has a consolidated expertise in insolvency law and as a court administrator.

Identifying innovative solutions, he assists companies in a state of crisis and investors, including foreign ones, in debt restructuring and turnaround operations in situations of financial stress, making use of the instruments of the crisis code including certified recovery plans, restructuring agreements and preventive agreements.

He is a point of reference in the reflection on the over-indebtedness crisis, a subject in which, in addition to being author of several monographs and scientific contributions, he is advisor to innovative start-ups, minor companies and guarantors of companies involved in restructuring procedures.

He was among the first to be appointed as an expert in crisis settlement for negotiated settlement ex DL 118/2021 by the Chamber of Commerce of Milan, Monza Brianza and Lodi and is a manager for several crisis settlement bodies and judicial administrator of companies within preventive seizures.

He has been heard at the Chamber of Deputies and Senate on the code of corporate crisis and insolvency on behalf of the Milan Bar Association.

He collaborates on a regular basis with several bankruptcy receivers and with the Prevention Measures section of the Court of Milan as judicial administrator and as coadjutor.

He also deals with collective judgments in banking and financial law and derivatives.

He regularly participates as a speaker at conferences and seminars on over-indebtedness and crisis law; he lectures on corporate crisis and banking law for prestigious publishers and professional schools such as Giuffrè, WoltersKluwer, SAF (Scuola di Alta formazione Luigi Martino dell’Ordine dei commercialisti di Milano) and Fondazione Forense.

He is a columnist for the daily newspaper Sole24ore, in the Norme e Tributi section.
